Privacy Policy

Last Updated:  May 31, 2014

At Weeva, Inc. (“Weeva,” “Service,” “we,” or “us”), protecting our users’ privacy and security is a top priority.  For this reason, we have adopted this privacy policy (“Privacy Policy”) to advise you of your choices regarding the use of your personal information online.  This Privacy Policy describes what types of information we gather about you when you use the Service, how we use it, under what circumstances we disclose it to third parties, and your rights to update or correct it.  By using the Service, you accept this Privacy Policy and fully understand and unambiguously consent to the collection and processing of any information you provide to us. You also understand that such information may be processed by us or on our behalf in the country where it was collected as well as other countries where laws regarding processing of personal information may be less stringent than the laws in your country.

This Privacy Policy applies only to www.Weeva.com (“Website”) and the way that Weeva handles your information. If you choose to disclose information to others, including to other users of the Service, the use and disclosure restrictions contained in this Privacy Policy may not apply to such third party. Similarly, this Privacy Policy does not apply to third party websites, services, or applications to which we link or to which you otherwise connect with through the Service (e.g, Facebook), and you understand and agree that we cannot control and are not responsible for the information collection practices of any such websites, services, or applications. Such links may appear as a specific domain name or URL or may be activated by clicking on an advertisement or other icon or graphic. By linking to a non-Weeva website or webpage, we do not represent or imply that the Service endorses such website or webpage. Weeva disclaims any responsibility for any harm resulting from your use of non-Weeva websites and webpages, and you are therefore responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. We encourage you to carefully review the terms of use, privacy policies, and any other legal notifications on such websites before using or providing information through such websites, services, or applications. Further, the Service may employ third party technologies that require you to accept such third party’s terms. This Privacy Policy does not cover the information practices of those third party technologies.

What We Collect

We may collect information about you in several different ways:

  • Information You Give Us. In order to use some of the Website, we may ask you to provide “Personal Information,” including, without limitation, your‎ name,‎ birthdate, gender, email address,‎ username,‎ password, mailing and/or billing address, telephone number, cell phone number, credit card number and expiration date. For example, to post or respond to content on the Website, you must either: (a) create an “Account” by providing your name, birthdate, email address, and a password of your choosing or (b) connect to the Website through Facebook or another social networking, i.e., SN Site (defined below). When you communicate with us by sending us an email, we will collect and store any information that is contained in your communications with us. You are welcome to share as much information as part of your comments or responses as you think is necessary and/or appropriate. If you include Personal Information in such comments or responses, we will not consider it to be Personal Information under this Privacy Policy.
  • Information We Get from Others. We may get information about you from other sources, including SN Sites and anyone who invites you to participate on our Website. We may add this to information we get from our Website.
  • Information Automatically Collected. We may collect information through technology to make the Service more useful and/or for business purposes.  We may also combine this information with Personal Information. For example, when you access the Website, like many other online businesses, we automatically log information about you and your computer such as your computer operating system type,‎ browser type,‎ browser language,‎ the website you visited before browsing to our Website,‎ pages you viewed,‎ how long you spent on a page,‎ access times,‎ Internet protocol (IP) address, and information about your use of and actions on our Website. In addition, we may use “cookies,” “web beacons,” and/or similar technologies from your web browser to track and maintain information in relation to the Website, advertisements thereon, and the software, including, without limitation, how you use the Website and whether you return to the Website. These technologies may store information on your computer and allow us to customize your experience, optimize the Website, or facilitate your signing in to use the Website. Your web browser may allow you to opt-out of our collection of tracking information by selecting a “do not track” (or similar) setting. However, we do not currently have processes to address those settings or other “do not track” requests, and consequently, cannot guarantee that we will honor such requests. If you do not want us to collect this information, please do not use the Website.
  • Anonymous/Aggregated Information. We gather certain generic information with respect to customers' use of the Website, such as the number of unique visitors, the frequency with which they visit, and the areas on the Website that they favor. We may also take your Personal Information and make it non-personally identifiable, either by combining it with information about other individuals (e.g., aggregating your information with information about other individuals) or by removing characteristics (such as your full name) that make the information personally identifiable to you (de-personalizing your information). We may share this type of data in the aggregate – that is, we look at the data on a collective basis, in summary form, rather than on an individual basis. This data helps us determine the extent to which our customers use certain parts of the Website, which, in turn, enables us to make it as appealing as possible. We may also provide statistical "ratings" about how our customers collectively use the Website to advertisers, sponsors, and other companies with which we do business. These statistical ratings do not contain any personally identifiable information about you or any of our users. Given the nature of such non-personally identifiable information, you grant to us a perpetual, non-exclusive, transferable, sub-licensable, royalty-free license to use data that we collect from you via your use of and interaction with the Service (“Data”) in order to collect, develop, create, extract or otherwise generate statistics and other information and to compile, synthesize, and analyze Data (“Blind Data”). To the extent that we collect or generate Blind Data, the Blind Data will be owned by us and may be used for any lawful business purpose without a duty of accounting to you, provided that the Data is not personally identifiable and does not identify the source of such Data.

Responsibility of Website Visitors

Weeva has not reviewed, and cannot review, all of the material posted to the Website, including, without limitation, any text, images, logos, links, designs, graphics, and audio/video clips contributed to the various tapestries on the Website, and cannot therefore be responsible for that material’s content, use or effects. By operating the Website, we do not represent or imply that we endorse the material there posted, or that we believe such material to be accurate, useful or non-harmful. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, and other harmful or destructive content. The Website may contain content that is offensive, indecent, or otherwise objectionable, as well as content containing technical or historical inaccuracies, typographical mistakes, and other errors. The Website may also contain material that violates the privacy or publicity rights, or infringes the intellectual property and other proprietary rights, of third parties, or the downloading, copying or use of which is subject to additional terms and conditions, stated or unstated. We disclaim any and all responsibility for any harm resulting from the use by visitors of the Website, or from any downloading by those visitors of content there posted.

Copyright Infringement and DMCA Policy

As we ask others to respect our intellectual property rights, we respect the intellectual property rights of others. If you believe that material located on the Website or linked to by the Service violates your copyright, you are encouraged to notify us in accordance with our DMCA policy. We may terminate a visitor’s access to and use of the Website if, under appropriate circumstances, the visitor is determined to be a repeat infringer of the copyrights or other intellectual property rights of us or others. In the case of such termination, we will have no obligation to provide a refund of any amounts previously paid to us.

Intellectual Property

This Privacy Policy does not transfer from us to you any intellectual property owned or controlled by us or third party intellectual property, and, as between us and you, all right, title and interest in and to such property will remain solely with us. Arkestrel, Weeva, Weeva.com and the Weeva logo, and all other trademarks, service marks, graphics and logos used in connection with the Website are trademarks, service marks, or registered trademarks or service marks of Weeva or our licensors. Other trademarks, service marks, graphics and logos used in connection with the Website may be the trademarks of other third parties. Your use of the Website grants you no right or license to reproduce or otherwise use any of our trademarks or service marks or any third-party trademarks.

Our Relationship with Social Networking Sites

We have created and may offer you interfaces that allow you to connect with social networking websites such as Facebook and Twitter (each individually an “SN Site” and collectively, “SN Sites”) through our Website. We will work with the SN Site’s application protocol interface (better known as their developer API) in a way that allows you to authorize us to access your account on that SN Site on your behalf. In order to provide this authorization, you will not provide us with your user name or password to the SN Site, but you will need to log-in to that SN Site directly through our Website. Once authorized by you, the SN Site will provide us a token that allows the SN Site to recognize us when we ask, on your behalf, for access to your account information. You will be able to revoke our access to any SN Site at any time by amending the appropriate settings from within your account settings on the applicable SN Site, though such revocation may limit the features of the Website we are able to provide you.

Use of Personal Information

Notwithstanding anything to the contrary in this Privacy Policy, we may use your Personal Information as follows:

  • to operate, maintain, and improve our sites, products, and services
  • to respond to comments and questions and provide customer service
  • to send information including invitations, confirmations, requests, activity digests, invoices, shipping notices, technical notices, updates, security alerts, and support and administrative messages
  • to distribute Weeva Books and physical products
  • to communicate about promotions, upcoming events, and other news about products and services offered by us and our selected partners, though we will not disclose your personal information in doing so
  • to link or combine user information with other personal information
  • to protect, investigate, and deter against fraudulent, unauthorized, or illegal activity
  • to provide and deliver products and service customers request
  • to create anonymous information by excluding information that makes the information personally identifiable to you

Sharing of Personal Information

We may share your personal information or other information when we believe in good faith that such disclosure is required by law, legal process, or court order (e.g., to comply with a subpoena); to protect the rights and property of us, our agents, customers, and others, including enforcing our agreements, policies, and terms of use; to protect the personal safety or property of you, our users, the public, our licensors or ourselves and the Website (e.g., in an emergency); and as may be required to respond to an inquiry, request, or complaint you have made. We may freely share information with a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “ Affiliates”), in the event we have such Affiliates in the future. We may also use your personal and non-personal information in connection with the operation of the Service.  For example, we may use your information to improve and personalize your use of the Service or to track and monitor traffic on the Website. We may also share your personal information to the extent needed to do business with companies we hire to provide products, services, or information, such as a company that helps process credit card transactions, or with persons and entities that provide support for the internal operations of our online services (e.g., technical support). We may also share aggregated and/or anonymized data in our discretion with others for their own uses. Otherwise, we may only share your personal information or other information with third parties with your consent.

No Spam Policy

We and our users hate spam email. Please set your notification preferences so that our communications with you are limited to your preferences. Unless you instruct us otherwise, we may contact you with commercial information about products, services, promotions, contests or other activities or offerings that may be of interest to you. Also, we may contact you to provide you with information concerning your account, your use of the Website, Website announcements, Service and software updates and changes to our Terms of Service, this Privacy Policy or other similar items, without your specific consent.

Updating Your Personal Information

You may send requests about personal information to our Contact Information below. You can request to change contact choices and update your personal information by accessing your profile on the Website.

You can typically remove and reject cookies from our Website with your browser settings. Many browsers are set to accept cookies until you change your settings. If you remove or reject our cookies, it could affect how our Website works for you.

You can also review and/or change certain of your personal information by logging into the Website. You authorize us to use and disclose any new or modified information that you provide in accordance with this Privacy Policy, and you agree that we are under no obligation to delete or modify information that you have previously chosen to provide us. Please know, however, that if we receive your name directly from an SN Site, you may not be able to change this information through the Website. You must change this information through the SN Site. Additionally, if we have already disclosed some of your personal information to third parties, we cannot access that personal information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

If you provide feedback to us, we may use and disclose such feedback for any purpose, provided we do not associate such feedback with your Personal Information. We will collect any information contained in such feedback and will treat the personal information in it in accordance with this Privacy Policy.

Security and Access

We take great care in maintaining the security of your Personal Information and preventing unauthorized access to it. We protect your information using commercially reasonable technology and internal procedures. Although we work hard to protect your Personal Information, as you know, we cannot guarantee that unauthorized access will never occur.  Unscrupulous advertisers, hackers, and scam artists are constantly searching the Internet looking for new targets. Consequently, we cannot ensure or warrant the security of your Personal Information and you acknowledge and agree that you transmit it to us at your own risk. Your best protection is to understand the limits to privacy on the Internet and use common sense in all of your online activities.

Be aware that email is an inherently insecure form of communication. Remember that third parties are sometimes able to illegally intercept your unencrypted messages, including online greetings. Anytime you visit a chat room or post a message to an online bulletin board, your email address can be accessed by advertisers looking to compile lists for unsolicited commercial email. Be sure that you only disclose your email address in circumstances in which it is safe to do so.  Beware of scams in which persons unknown to you request your screen name, password, or credit card information. Make sure you verify the identity of anyone asking for personal information.

Children Under 13

The Website is not directed to children under the age of 13. We are committed to protecting the privacy and rights of children online. We believe that children should be able to use the Internet in a safe, productive, and efficient manner and should be afforded the highest protection available with respect to their personal information. To that end, we have made it our policy to not collect or maintain any individually identifiable information from users we actually know are under 13 years of age, and no part of our Website is designed to attract people under 13 years of age.

The Children's Online Privacy Protection Act ("COPPA") imposes certain requirements upon websites and online services that are directed toward children, including obtaining the consent of parents and guardians in order for children under 13 years of age to use certain features of the website.  To learn more about COPPA, visit the Federal Trade Commission COPPA Web Site at http://www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/childrens-online-privacy-protection-rule

If you are a parent and believe that your child has submitted personal information to us, please contact us via email or postal mail as listed below. We will promptly delete the information upon learning that it relates to a child under the age of 13. Please note that it is possible some of this information may remain archived in web logs and backup archives after we delete the information from our active database.

International Transfers

Information collected from you may be stored and processed in the United States or any other country in which we or our affiliates, subsidiaries, agents, or contractors maintain facilities. If you are accessing the Service from the European Union or other regions with laws governing data collection and use, please note that you are agreeing to the transfer of your data to the United States and processing globally. By providing your information, you consent to any transfer and processing in accordance with this Privacy Policy.

Sale of Assets

In the event that the Service is ever sold, acquired, merged, liquidated, reorganized, or otherwise transferred, we reserve the right to transfer our user databases together with any Personal Information contained therein, to a third-party acquiring the Service’s assets. In the event we do so, we will use commercially reasonable efforts to ensure that the applicable third party is obligated to treat your personal information in the same manner required by this Privacy Policy.

Changes to Privacy Policy

We may change this Policy by posting a new version of this Privacy Policy on the Website or through the Service, and it is your responsibility to review this policy from time to time. When we do change the policy, we will also revise the “last updated” date and may notify you or post a message on the Website and/or through the Service. Your continued use of the Website constitutes your agreement to this Privacy Policy and any updates.
